General Rules of Interpretation (GRI)

[호, 주의 최우선 적용원칙]

1. 이 표의 부 류 및 절의 표제는 참조하기 위하여 규정한 것이다. 법적인 목적상 품목분류는 각 호의 용어와 관련 부나 류의 주에 따라 결정하되, 각 호나 주에서 따로 규정하지 않은 경우에는 다음 각 호의 규정에 따른다.

1. The table of contents, alphabetical index, and titles of sections, chapters and sub-chapters are provided for ease of reference only; for legal purposes, classification shall be determined according to the terms of the headings and any relative section or chapter notes and, provided such headings or notes do not otherwise require, according to the following provisions:

2(a). 각 호에 열거된 제품에는 불완전한 물품이나 미완성된 물품이 제시된 상태에서 완전한 물품이나 완성된 물품의 본질적인 특성을 지니고 있으면 그 불완전한 물품이나 미완성된 물품이 포함되는 것으로 본다. 또한 각 호에 열거된 제품에는 조립되지 않거나 분해된 상태로 제시된 물품도 완전한 물품이나 완성된 물품(이 통칙에 따라 완전한 물품이 완성된 물품으로 분류되는 것을 포함한다.)에 포함되는 것으로 본다.

2(a) Any reference in a heading to an article shall be taken to include a reference to that article incomplete or unfinished, provided that, as entered, the incomplete or unfinished article has the essential character of the complete or finished article. It shall also include a reference to that article complete or finished (or falling to be classified as complete or finished by virtue of this rule), entered unassembled or disassembled.

2(b). 각 호에 열거된 재료 물질에는 해당 재료 물질과 다른 재료 물질과의 혼합물 또는 복합물이 포함되는 것으로 본다. 특정한 재료 물질로 구성된 물품에는 전부 또는 일부가 해당 재료 물질로 구성된 물품이 포함되는 것으로 본다. 두 가지 이상의 재료나 물질로 구성된 물품의 분류는 이 통칙 제3호에서 규정하는 바에 따른다.

(b) Any reference in a heading to a material or substance shall be taken to include a reference to mixtures or combinations of that material or substance with other materials or substances. Any reference to goods of a given material or substance shall be taken to include a reference to goods consisting wholly or partly of such material or substance. The classification of goods consisting of more than one material or substance shall be according to the principles of rule 3.

3. 이 통칙 제2호 (b)목이나 그 밖의 다른 이유로 동일한 물품이 둘 이상의 호로 분류되는 것으로 볼 수 있는 경우의 품목분류는 다음 각 목에서 규정하는 바에 따른다.

3. When, by application of rule 2(b) or for any other reason, goods are, prima facie, classifiable under two or more headings, classification shall be effected as follows:

3(a). 가장 구체적으로 표현된 호가 일반적으로 표현된 호에 우선한다. 다만, 둘 이상의 호가 혼합물이나 복합물에 포함된 재료나 물질의 일부에 대해서만 각각 규정하거나 소매용으로 하기 위하여 세트로 된 물품의 일부에 대해서만 각각 규정하는 경우에는 그 중 하나의 호가 다른 호보다 그 물품에 대하여 더 완전하거나 상세하게 표현하고 있다 할지라도 각각의 호를 그 물품에 대하여 동일하게 구체적으로 표현된 호로 본다.

3(a) The heading which provides the most specific description shall be preferred to headings providing a more general description. However, when two or more headings each refer to part only of the materials or substances contained in mixed or composite goods or to part only of the items in a set put up for retail sale, those headings are to be regarded as equally specific in relation to those goods, even if one of them gives a more complete or precise description of the goods.

3(b). 서로 다른 재료로 구성되거나 서로 다른 구성요소로 이루어진 복합물과 소매용으로 하기 위하여 세트로 된 물품으로서 가목에 따라 분류할 수 없는 것은 가능한 한 이들 물품에 본질적인 특성을 부여하는 재료나 구성요소로 이루어진 물품으로 보아 분류한다.

3(b) Mixtures, composite goods consisting of different materials or made up of different components, and goods put up in sets for retail sale, which cannot be classified by reference to 3(a), shall be classified as if they consisted of the material or component which gives them their essential character, insofar as this criterion is applicable.

3(c). 가목이나 나목에 따라 분류할 수 없는 물품은 동일하게 분류가 가능한 호 중에서 그 순서상 가장 마지막 호로 분류한다

3(c). When goods cannot be classified by reference to 3(a) or 3(b), they shall be classified under the heading which occurs last in numerical order among those which equally merit consideration.

4. 이 통칙 제1호부터 제3호까지에 따라 분류할 수 없는 물품은 그 물품과 가장 유사한 물품이 해당되는 호로 분류한다.

4. Goods which cannot be classified in accordance with the above rules shall be classified under the heading appropriate to the goods to which they are most akin.

5. 다음 각 목의 물품에는 이 통칙 제1호부터 제4호까지를 적용하는 외에 다음 사항을 적용한다.

5. In addition to the foregoing provisions, the following rules shall apply in respect of the goods referred to therein:

5(a). 사진기 케이스·악기 케이스·총 케이스·제도기 케이스·목걸이 케이스와 이와 유사한 용기는 특정한 물품이나 물품의 세트를 담을 수 있도록 특별한 모양으로 되어 있거나 알맞게 제조되어 있고, 장기간 사용하기에 적합하며, 그 내용물과 함께 제시되어 그내용물과 함께 정상적으로 판매되는 종류의 물품인 때에는 그 내용물과 함께 분류한다. 다만, 용기가 전체 물품에 본질적인 특성을 부여하는 경우에는 그렇지 않다.

(a) Camera cases, musical instrument cases, gun cases, drawing instrument cases, necklace cases and similar containers,specially shaped or fitted to contain a specific article or set of articles, suitable for long-term use and entered with the articles for which they are intended, shall be classified with such articles when of a kind normally sold therewith. This rule does not,however, apply to containers which give the whole its essential character;

5(b). 가목에 해당하는 것은 그에 따르고, 내용물과 함께 제시되는 포장재료와 포장용기는 이들이 그러한 물품의 포장용으로 정상적으로 사용되는 것이라면 그 내용물과 함께분류한다. 다만, 그러한 포장재료나 포장용기가 명백히 반복적으로 사용하기에 적합한 것이라면 그렇지 않다.

5(b). Subject to the provisions of rule 5(a) above, packing materials and packing containers entered with the goods therein shall be classified with the goods if they are of a kind normally used for packing such goods. However, this provision is not binding when such packing materials or packing containers are clearly suitable for repetitive use.

6. 법적인 목적상 어느 호 중 소호의 품목분류는 같은 수준의 소호들만을서로 비교할 수 있다는 점을 조건으로 해당 소호의 용어와 관련 소호의 주에 따라 결정하며, 위의 모든 통칙을 준용한다. 또한 이 통칙의 목적상 문맥에서 달리해석되지 않는 한 관련 부나 류의 주도 적용한다.

6. For legal purposes, the classification of goods in the subheadings of a heading shall be determined according to the terms of those subheadings and any related subheading notes and, mutatis mutandis, to the above rules, on the understanding that only subheadings at the same level are comparable. For the purposes of this rule, the relative section, chapter and subchapter notes also apply, unless the context otherwise requires.
